Terms of Service

These Terms of Service ("Terms") govern your access to and use of Stealth, a privacy and security software suite provided by FVTAL, LLC ("we," "us," "our," or "Company"). By accessing or using Stealth, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use Stealth.

1. Acceptance of Terms

By creating an account, purchasing a subscription, downloading, installing, or using Stealth software or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Stealth on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Stealth is a comprehensive privacy and security software suite for Windows and Android that provides:

VPN (Virtual Private Network) service with WireGuard encryption
DNS encryption and secure DNS services
System-wide ad blocking and tracker prevention
End-to-end encrypted messaging (StealthChat)
Encrypted file transfer (Stealth Transfer)
Password management (Stealth Vault)
System utilities including cleaner, firewall, task manager, and more
AI assistant for system operations

We reserve the right to modify, suspend, or discontinue any aspect of Stealth at any time, with or without notice.

3. Account Registration and License

3.1 Account Creation

To use Stealth, you must create an account by providing a valid email address and license code. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 License Terms

Your subscription to Stealth grants you a limited, non-exclusive, non-transferable, revocable license to use Stealth software on up to three (3) devices per license. This license is subject to the following restrictions:

You may not share, sell, rent, lease, or otherwise transfer your license to any third party
You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of Stealth
You may not modify, adapt, alter, or create derivative works of Stealth
You may not remove, alter, or obscure any proprietary notices or labels in Stealth
You may not use Stealth for any illegal or unauthorized purpose

3.3 License Validation

Stealth requires periodic online validation of your license. The software will validate your license weekly when connected to the internet. If you are offline, Stealth provides a 7-day grace period before requiring revalidation. Continued use of Stealth requires an active, valid subscription.

3.4 Device Activation

Each license allows activation on up to three (3) devices. Device activation is tied to your device's hardware identifier. You may deactivate devices through the application to free up activation slots. Attempting to activate on more than three devices will result in the oldest activation being automatically deactivated.

4. Subscription and Payment

4.1 Subscription Plans

Stealth is available through a monthly subscription plan. Current pricing is $6.99 USD per month, billed monthly. We reserve the right to change pricing with 30 days' notice to existing subscribers.

4.2 Payment Terms

By purchasing a subscription, you agree to pay all fees associated with your subscription. Payments are processed through Stripe, a third-party payment processor. You are responsible for providing accurate payment information and authorizing us to charge your payment method for all fees.

Subscriptions automatically renew at the end of each billing period unless cancelled. You authorize us to charge your payment method for each renewal period.

4.3 Refund Policy

We offer a 30-day money-back guarantee for new subscriptions. If you are not satisfied with Stealth within the first 30 days of your initial subscription, contact us for a full refund. Refunds are not available for:

Subscriptions cancelled after 30 days
Renewal periods
Violations of these Terms

To request a refund, contact us through the support system in the application or via email. Refunds will be processed within 10 business days.

4.4 Subscription Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. Upon cancellation, your license will be revoked and access to Stealth will terminate at the end of the billing period. No refunds are provided for partial billing periods.

4.5 Failed Payments

If payment fails, we will attempt to charge your payment method again. If payment continues to fail, we may suspend or terminate your subscription and access to Stealth. You are responsible for maintaining valid payment information.

5. Acceptable Use

You agree to use Stealth only for lawful purposes and in accordance with these Terms. You agree not to:

Use Stealth to violate any applicable laws or regulations
Use Stealth to transmit, distribute, or store any material that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Use Stealth to infringe upon intellectual property rights
Use Stealth to transmit malware, viruses, or other harmful code
Attempt to gain unauthorized access to any systems or networks
Interfere with or disrupt the operation of Stealth or our servers
Use automated systems to access Stealth in a manner that sends more requests than a human could reasonably produce
Resell, redistribute, or sublicense Stealth or any portion thereof
Use Stealth to bypass geographic restrictions for illegal purposes
Use Stealth in a manner that violates the rights of others

Violation of these restrictions may result in immediate termination of your account and subscription without refund.

6. Intellectual Property

Stealth, including all software, documentation, graphics, logos, and other materials, is the exclusive property of FVTAL, LLC and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by FVTAL, LLC.

The Stealth name, logo, and related marks are trademarks of FVTAL, LLC. You may not use our trademarks without our prior written consent.

7. User Content and Data

7.1 Your Data

You retain ownership of all data you create, upload, or transmit through Stealth. As detailed in our Privacy Policy, we do not log, monitor, or store your browsing activity, messages, or other user content. Your data is encrypted and stored locally on your device.

7.2 License to Use Your Data

By using Stealth, you grant us a limited license to process your data solely to provide the service. This includes:

Processing encrypted messages for delivery (we cannot decrypt them)
Storing encrypted files temporarily for transfer (we cannot decrypt them)
Validating your license and subscription status

We do not claim ownership of your content, and you retain all rights to your data.

7.3 Data Backup

You are solely responsible for backing up your data. We are not responsible for any loss of data, including passwords stored in Stealth Vault, messages, or other content. We recommend regular backups of your encrypted vault.

8. Service Availability and Modifications

We strive to provide reliable service but do not guarantee that Stealth will be available at all times or free from errors, interruptions, or defects. We may:

Perform scheduled or unscheduled maintenance
Modify or discontinue features or services
Update software that may require you to download new versions
Suspend or terminate service for violations of these Terms

We are not liable for any loss or damage resulting from service interruptions or modifications.

9. Third-Party Services

Stealth may integrate with or use third-party services, including:

Stripe for payment processing
Google Drive for optional vault synchronization
DNS providers (Cloudflare, Google, Quad9)
Email services for account communications

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimers

STEALTH IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

Stealth will meet your requirements
Stealth will be uninterrupted, timely, secure, or error-free
Results obtained from using Stealth will be accurate or reliable
Defects in Stealth will be corrected

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FVTAL, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use Stealth
Unauthorized access to or alteration of your data
Statements or conduct of third parties
Any other matter relating to Stealth

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO STEALTH SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless FVTAL, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your use of Stealth
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations

13. Termination

13.1 Termination by You

You may terminate your account and subscription at any time by cancelling through your account settings or contacting support. Termination takes effect at the end of your current billing period.

13.2 Termination by Us

We may suspend or terminate your account and access to Stealth immediately, without prior notice, if:

You violate these Terms
You fail to pay subscription fees
You engage in fraudulent or illegal activity
We are required to do so by law
We discontinue the service

13.3 Effect of Termination

Upon termination:

Your license will be revoked
Access to Stealth will be disabled
Your account data may be deleted (subject to our Privacy Policy)
You will not receive a refund for any unused portion of your subscription

Sections of these Terms that by their nature should survive termination will survive, including Sections 6 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Dispute Resolution).

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms on our website
Sending an email to the address associated with your account
Displaying a notice in the Stealth application

Your continued use of Stealth after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using Stealth and cancel your subscription.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of your notice.

15.3 Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or Stealth shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The location of arbitration will be determined based on the location of FVTAL, LLC or as mutually agreed by the parties.

You waive your right to a jury trial and to participate in a class action lawsuit. Some jurisdictions do not allow arbitration clauses, so this provision may not apply to you.

16. Export Restrictions

Stealth may be subject to export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations. You may not export or re-export Stealth to any country, person, or entity prohibited by such laws.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FVTAL, LLC regarding your use of Stealth and supersede all prior agreements and understandings.

19. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.

20. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without your consent in connection with a merger, acquisition, or sale of assets.
